1. General Provisions

 

These General terms and conditions (GTC) shall apply to all contractual relations, sales, rental companies and comparable transactions, to the extent not explicitly written in different arrangements have been made. Any deviating terms and conditions of the contractual partner, we recognize only if this has been expressly agreed in writing. Oral Promises or agreements, including through our staff – develop only valid if they are confirmed in writing. The place of jurisdiction for all disputes is, if the contractual partner is a merchant, a legal entity of public Law or a public-law special Fund.

 

2. Orders and conclusion of contract

 

Orders must be made in writing. Information contained in catalogues, price lists or on our site are for guidance only and are not binding. Despite careful control, we reserve the right to correct printing or calculation errors. Changes in design, equipment, or the scope of supply are possible.
Our website does not constitute a sale portal, but is for Information purposes only. An automatically generated confirmation of receipt in the case of requests shall not by contract. After examination of the request, the customer receives a binding offer. Only with the acceptance of this offer by the customer, the contract is concluded.
BMUsik provides, through the offer of additional services, these will be calculated separately. About any more, the customer will be informed of the cost. With Delivery, pickup, or delivery of the leased property, the contract partner confirmed to be with their use.

Note: In the case of consumer contracts, at a distance, eliminates the right of withdrawal, if a fixed date/period of time has been agreed or a customer-specific configuration is done.

 

3. Cancellations by the customer

 

For orders up to a net value of € 500, the customer may withdraw no later than three days prior to arrival free of charge. The cancellation is made within this period, is to pay the full rental price to.
The order value is over 500 €, the following applies:

up to 30 days prior to arrival: free of charge, however, will be made until then, any costs incurred in the invoice

29 to 20 days before: 25 % of the agreed price

19 to 10 days in advance: 50 % of the agreed price

from 10 days in advance: 100 % of the agreed price

 

4. Force Majeure

 

Events of force majeure, both parties for the duration of the impairment of its contractual obligations, delivered. The performance of the service is permanently impossible, either party can terminate the contract, claims for damages are excluded. Force majeure includes, in particular, war, official orders, Sabotage, strikes, natural disasters, epidemics or geological events. 5. Rental period

 

The minimum rental period is one day and is calculated in days.

6. Prices, Deposit, Payment Modalities

Deposits may be charged and will be refunded upon proper return. If return is delayed, an additional amount of the rental will be charged.
The payment is made, unless otherwise agreed at the time of Delivery in cash. Payments in advance, PayPal, or other methods are possible after agreement. Payment by invoice must be confirmed explicitly. Cheque and direct debit payments are excluded. Offsetting is only with undisputed or legally established claims.

 

7. Delivery

 

Deliveries will be made, if agreed, up to the first lockable door. The customer shall inspect the goods upon Delivery for completeness and freedom from defects and to confirm it. Complaints are subsequently excluded. Deliveries are always done on the customer's risk. Compensation in case of delays, is only in the case of gross negligence or premeditation.

 

8. Payment terms

 

All invoices are payable immediately without deduction, unless otherwise agreed. In the event of late payment BMUsik default interest, as well as a processing fee of up to € 40 can collect. The customer is in default, can be rented items to be recovered.

 

9. Mounting

 

Monday services are provided only at the Express request and at a charge. Required extra work for the security or performance of the contract is necessary to be calculated after consultation. For Work of a third party BMUsik accepts no liability. The transfer of risk is not affected by installation services.

 

10. Treatment of the leased property

 

The customer is obligated to treat the rented property, and damage, weathering and protect theft. Unauthorized repairs is prohibited. Return cleaned, complete, and accepted. When you pick up the goods transportation must be ready.

 

11. Return

 

The return is the same as in point 10 will be described. All items must be cleaned, fully sorted and ready.

 

12. Damage and loss

 

The customer is liable for all damages, losses, or incomplete returns. Repair and replacement cost will be charged. In addition, BMUsik charges a processing fee (25 € to 100 € amount of damage, 50 € from 101 €). During the repair or replacement of the loss of rent is calculated. Insurance on BMUsik is possible, even the participation of a minimum of €1,000.

 

13. Retention of title

 

The delivered Goods remain until full payment of the property of BMUsik. The customer is obliged to treat the goods with care and, if necessary, to assure sufficient.

 

14. Passing of risk

 

The risk is transferred, or load, on the customer – even in the case of carriers or Collectors. Maintenance, or installation services will change that.

 

15. Artist

 

For pre-booked artist artistic freedom. Refunds excluded are not liked. In the event of cancellation within 14 days prior to the date of 50% of the fee will be charged.

 

16. Resignation

 

BMUsik may withdraw from the contract if the wrong information has been made, payments are set or insolvency has been requested. Claims for compensation are excluded.

 

17. Warranty

 

In the case of defects BMUsik has the right to repair or replacement. Only if these fail, it can reduce the customer. Obvious defects are to be reported immediately. Damage due to improper handling are excluded.

 

18. Liability

 

BMUsik shall only be liable in cases of intent, gross negligence, injury of life, body or health, as well as for the violation of essential contractual obligations. The liability is limited to the foreseeable, typical damages. For rental equipment caused damage to property BMUsik is not liable, except in cases of intent or gross negligence.

 

19. Privacy

 

Personal data will only be processed in accordance with the applicable data protection law and saved. They serve the purpose of contract processing and, if necessary, a Follow-up. For More Information: Privacy Statement

 

Supplier terms and conditions


1. Scope

 

All orders placed by us and are based exclusively on these terms and conditions. With the acceptance of the contract, the contractor acknowledges this. Different provisions apply only if they are confirmed in writing. These conditions also apply for all future transactions.

 

2. Order processing

 

Deliveries and services must conform to the agreed specifications. Prices and delivery dates are binding. The contractor shall bear the costs and risks of transportation. Required documents and certificates requested it to submit.

 

3. Changes

 

More benefits are only paid if they have been announced in advance in writing and confirmed by us.

 

4. Passing of risk

 

The risk is only after acceptance by us.

 

5. Complaint

 

Open and hidden defects are to be remedied by the contractor without delay. We reserve the right to damages and replacement costs.

 

6. Deadlines

7. Special conditions

 

The contractor is obliged to provide services personally or through authorized employees. All costs are included in the agreed price, unless otherwise specified. Use of auxiliaries or props can be specified.

 

8. Customer protection

 

Direct contact with the customer is prohibited. Inquiries are to be immediately forwarded to us. In the event of violations, we reserve the right to compensation claims from damage.

 

9. Rights of use

 

All usage and exploitation rights are unrestricted on us or our customers.

 

10. Rights Of Third Parties

 

The contractor warrants that no rights of third parties.

 

11. Liability

 

In the case of damage to third parties the contractor shall indemnify us from any and all liability.

 

12. Confidentiality

 

All in connection with the order information received is strictly confidential.

 

13. Final provisions

 

German law applies. Jurisdiction is Berlin.
